Terms of service

These Terms of Service apply to the CLMSY website at clmsy.com and purchases made through it. CLMSY is operated by DONALD CHARLES BURNS, an individual business operator in Somerton, Arizona. “We,” “us” and “our” refer to that operator. Please review these terms and the linked policies before ordering.

1. Using the store

You must be legally able to enter the purchase contract, or use the store with the involvement of a parent or guardian where appropriate. Use the store lawfully and provide accurate information for your order. You must not use another person’s identity or payment details without permission, introduce malicious code, interfere with the website’s operation or attempt unauthorized access to accounts or data.

2. Account and contact information

Where account features are available, keep your sign-in information and order-status links private. Keep your email address and delivery information accurate so that order notices can reach you. Contact us promptly if you suspect unauthorized use of your account or a mistake in an order.

3. Product information

Our catalog identifies products by their brand, model and available options. Items offered are new and unused. Read the individual description, specifications and options before ordering. Sizes, compartments and other features vary by model; information about one product does not apply automatically to another. Screen settings can affect how a color appears, but this does not remove your rights if an item does not match its description.

CLMSY is an independent retailer. Brand and product names identify goods and their owners; their appearance on the site does not make CLMSY the manufacturer or the brand’s official store.

4. Orders and availability

Review the selected product options, quantity, delivery address and total before submitting an order. An automated confirmation acknowledges that we have received the order. If an availability, payment or other material problem prevents fulfillment, we will contact you. We do not substitute a different product or increase an accepted order’s price without your agreement. If we cannot fulfill an order, we will cancel the affected part and refund the amount paid for it.

5. Prices, payment and tax

Prices are in US dollars. Your final checkout total identifies the merchandise amount, selected shipping charge and any applicable tax before you place the order. Available payment methods are displayed in checkout. Payment must be authorized through the selected method for an order to be processed. We do not ask you to email full card details, a security code or a one-time verification code.

Prices may change for future orders. A later price change does not authorize an additional charge to an order already placed. If a material pricing or description error affects an order, we will explain the issue and seek your agreement to any proposed change, or cancel and refund the affected order as appropriate.

6. Processing and delivery

We currently deliver within the United States from Somerton, Arizona. Order processing takes 1–3 business days. Standard delivery is $13.95 per order with an estimated 7–12 business days in transit after dispatch; Express is $23.95 per order with an estimated 2–5 business days in transit after dispatch. There is no free-shipping threshold.

The order cutoff is 5:00 p.m. Pacific Time (America/Los_Angeles), Monday–Friday. The Shipping Policy explains the business-day definition, total estimates, tracking and delay handling. If we cannot ship within the stated period, we will notify you, seek any required consent to a delay and provide cancellation and refund options as required. Shipment delays do not remove statutory consumer rights.

7. Changes, cancellations, returns and refunds

For an address change or cancellation request, contact us promptly with your order number. We will confirm what can be changed at the order’s current stage. A request is not a confirmed change until we acknowledge it; dispatch may limit the changes possible.

Our Return and Refund Policy explains eligibility, how to request a return, return-related charges and refund timing. Read it before ordering and contact us before sending an item back. Nothing in these terms limits rights or remedies that cannot lawfully be excluded, including rights concerning goods that are defective or materially not as described.

8. Privacy

Our Privacy Policy explains how personal information is handled in connection with browsing, orders and communications. Consent for optional marketing or tracking is handled separately where required; accepting shopping terms does not replace any legally required privacy choice.

9. Intellectual property and feedback

Website text, design and images may be protected by copyright or other rights. You may browse and use the site to consider and purchase products. You may not copy or reuse protected content for a separate commercial purpose without the relevant permission. Third-party brands retain their own trademark and other rights.

Any review or feedback you choose to submit must reflect your own experience, be lawful and avoid disclosing someone else’s private information. You retain rights in your original content; submitting feedback does not give CLMSY ownership of it or permission to fabricate an endorsement.

10. Shopify and third-party services

Our store is hosted on Shopify. Shopify supplies the ecommerce platform; the sales contract for CLMSY products is with DONALD CHARLES BURNS operating CLMSY. Payment services, carrier sites and other third-party services may have their own terms and privacy policies. Review the terms for any optional third-party service you choose to use.

11. Website availability and corrections

We may maintain or update the site, correct information and change features. Technical interruptions may occur. We will not use a website correction or interruption to remove obligations for an existing order or rights provided by law. If you find an error that could affect a purchase, please contact us.

12. Responsibilities and legal rights

You are responsible for your unlawful use of the store and for information you knowingly provide inaccurately. We remain responsible for our own legal obligations, our published commitments and the orders we accept. These terms do not exclude liability that cannot lawfully be excluded, require you to waive statutory consumer rights, or impose a mandatory arbitration or class-action waiver.

13. Applicable law and resolving a concern

These terms are governed by applicable United States federal law and the laws of Arizona, without displacing mandatory consumer protections that apply to you. If a concern arises, contact us with your order number and details so we can attempt to resolve it. Contacting us does not prevent you from using a remedy or forum available under applicable law.

14. Changes and interpretation

Updates to these terms will appear here with a revised date and apply prospectively. The terms applicable when you placed an order continue to govern that order unless a lawful change is agreed. If a provision is unenforceable, the remaining provisions continue to apply to the extent permitted by law. Failure to enforce a provision on one occasion does not automatically waive it for another.
