Privacy policy
Last updated: October 26, 2026
CLMSY is the online store operated by DONALD CHARLES BURNS at clmsy.com. In this policy, “CLMSY,” “we,” “us” and “our” mean that individual business operator. Our store uses Shopify to provide ecommerce services. This policy explains how personal information is collected, used and disclosed when you browse, order, create an account where available, or contact us.
Personal information means information that identifies, relates to or can reasonably be linked to an individual. It does not include information that has been properly anonymized so that it can no longer reasonably be linked to a person. This policy governs privacy matters if there is a conflict with our Terms of Service. Reading or using this policy is not a substitute for consent where consent is required.
1. Personal information we collect or process
The information involved depends on how you interact with the store and the services you use. Categories may include:
- Contact and delivery details: your name, email address, telephone number, billing address and delivery address.
- Order and transaction details: products viewed, selected or purchased; order number; amount paid; payment status; delivery information; and correspondence about changes, returns or refunds.
- Payment information: payment providers process information needed to complete your payment. The order information available to us may include payment method, confirmation and limited or masked payment details. Do not send full payment-card details to us by email or through a contact form.
- Account information: account contact details, sign-in information and preferences where you choose to use an account or a connected shopping service.
- Communications: the information you choose to include in a support request, contact form, email or other communication with us.
- Device and usage information: IP address, browser and device characteristics, cookie or similar identifiers, pages and products viewed, interactions with the store and related technical records.
2. Sources of personal information
We receive information directly from you when you shop or contact us; automatically through the store and its cookies or similar technologies; and from Shopify, payment providers, delivery providers and other service providers as necessary to operate the store. If you choose a third-party sign-in, payment, map or other integration, that provider may supply information according to the feature you use and its own privacy notice.
3. How we use personal information
- Provide the store and fulfill orders: operate checkout, process payments, prepare and deliver purchases, communicate order updates and handle after-sales requests.
- Customer service: answer product or order questions, verify the relevant order and resolve a complaint.
- Store operation and improvement: remember relevant settings, maintain account features, diagnose technical problems and understand store use.
- Security and fraud prevention: protect accounts and transactions, investigate suspected abuse and maintain the integrity of the services.
- Marketing and advertising, where used: send marketing where permitted and subject to applicable consent requirements, measure campaigns or provide relevant advertising through enabled services. You can unsubscribe from marketing emails without stopping necessary order communications.
- Legal and administrative purposes: keep required business records, comply with lawful requests, establish or defend legal claims and apply our published terms.
Where a law requires a legal basis for processing, the basis depends on the activity: fulfilling a contract or steps you request before a contract, complying with a legal obligation, legitimate business interests where permitted, or your consent where required. You may withdraw consent for future consent-based processing without affecting processing that was lawful before withdrawal.
4. How we disclose personal information
We disclose information as needed to run the store and carry out the purposes described above:
- To Shopify and providers supporting hosting, checkout, payments, security, analytics, customer communications and order delivery.
- To advertising or marketing providers when those services are used, subject to applicable consent and opt-out choices. Some uses of identifiers or browsing information for targeted advertising may be classified as “sale,” “sharing” or targeted advertising under certain privacy laws, even without a payment for the data.
- At your direction, such as when you select a third-party payment feature or interact with a third-party integration.
- When reasonably necessary to comply with law, respond to a valid legal process, protect rights or investigate fraud or security issues.
- In connection with an actual business transfer, subject to applicable confidentiality and legal requirements.
CLMSY is operated by an individual; this notice does not claim that we belong to a corporate group. We do not give other merchants permission to access your order information simply because they also use Shopify.
5. Our relationship with Shopify
Shopify hosts our store and processes information about your interactions to provide its ecommerce services. Information submitted through the store is shared with Shopify and relevant providers, which may process it outside your country. Shopify may also process information in its own role for services you use directly.
Shopify Network Intelligence is enabled for CLMSY. Shopify uses information about your interactions with this store, other merchants and Shopify to provide enhanced services, including store improvement, personalization and advertising features, subject to applicable privacy choices. Other merchants cannot access your personal information through this service. Shopify is responsible for processing in its own role and for responding to related rights requests. For details, read Shopify’s Consumer Privacy Policy. You can also visit Shopify’s privacy portal.
6. Cookies, privacy signals and choices
Shopify and the store use cookies and similar technologies for functions such as keeping a cart, maintaining a session and security. Depending on the features enabled, they may also support analytics, personalization or advertising. Where a cookie banner or privacy-preferences control is displayed, you can use it to manage the choices offered for your location. You can also adjust browser settings, although blocking necessary cookies may affect the cart or checkout.
Where available for your location, use the data-sharing opt-out link in the website footer to manage sale, sharing or targeted-advertising choices. You may also contact us to ask about the technologies used or exercise an applicable privacy right. We honor legally applicable opt-out preference signals, including Global Privacy Control, as required by applicable law. The treatment of other browser signals may differ. Shopify’s own privacy choices are available through its privacy portal.
7. Third-party websites and integrations
Links or integrations may take you to services operated by others, including payment services, maps, social platforms or carrier websites. Their handling of information is described in their own policies. Review those policies before providing information. Information you choose to post publicly on another service may be visible to others. A link does not, by itself, mean that CLMSY endorses that service or controls its privacy practices.
8. Children’s information
The store’s purchasing and account services are intended for adults or people acting with the involvement of a parent or guardian, as applicable. We do not knowingly collect personal information from children under 13. If you believe a child has provided personal information to us, contact us so we can investigate and take appropriate action. We do not knowingly sell or share the personal information of anyone under 16.
9. Security and retention
We use safeguards appropriate to the store and the information involved, but no website or method of transmission can guarantee absolute security. Keep order-status links and sign-in credentials private, and do not send sensitive payment information through email or the contact form.
We retain information for as long as reasonably needed for the purpose for which it was collected, including handling orders and support, meeting recordkeeping obligations, preventing fraud and resolving disputes. The applicable period depends on the record, the ongoing relationship and legal requirements. Information is deleted or de-identified when it is no longer needed, subject to applicable obligations.
10. Your rights and options
Depending on where you live and the law that applies, you may have rights to:
- Know whether we process your information and obtain access to it.
- Request a copy in a portable format, where applicable.
- Correct inaccurate information or request deletion.
- Object to or restrict certain processing, or withdraw consent where processing relies on consent.
- Opt out of sale, sharing or targeted advertising where those rights apply.
- Appeal a decision about a request or complain to an appropriate privacy authority where provided by law.
These rights are subject to legal conditions and exceptions. To make a request, contact info@clmsy.com. We may ask for information reasonably necessary to verify your identity and the request. An authorized agent may submit a request when allowed by law, with evidence of authority as required. We will not unlawfully discriminate against you for exercising your rights. We respond within the period required by applicable law and explain any permitted extension.
Use the unsubscribe link in a marketing email to stop those emails. You may still receive non-marketing messages needed to fulfill an order or respond to you. For information processed by Shopify in its own role, use Shopify’s privacy portal.
11. Complaints and questions
If you have a concern about our handling of information, email us with enough detail to understand it. Where applicable law provides an appeal, you may ask us to reconsider a decision by contacting the same address and identifying your original request. You may also contact the relevant public authority where the law provides that option.
12. International processing
Although CLMSY currently sells to US delivery addresses, Shopify and service providers may store or process information in other countries. Where a law requires safeguards for a cross-border transfer, the applicable safeguards must be used, such as an adequacy decision or recognized contractual safeguards where appropriate. Shopify provides further information about its own international processing in its privacy documentation.
13. Changes to this policy
We may update this policy when our operations, services or legal obligations change. The version posted on this page will show its update date. We will provide additional notice or obtain consent when required by applicable law.
